Terms of Service

These terms of service (“Terms”) govern your use of PotholeClaims.co.uk (“the Service”). By using the Service, you agree to these Terms.

1. Service description

PotholeClaims is a document preparation service. We generate claim pack documents based on the information you provide. These documents are designed to help you submit a compensation claim to the responsible authority for pothole damage.

2. Not legal advice

PotholeClaims does not provide legal advice and is not a law firm. The documents, templates, and information we provide are for general guidance only. They should not be treated as a substitute for professional legal advice. We make no guarantee that your claim will be successful.

If you need legal advice about your specific situation, you should consult a qualified solicitor.

3. No guarantee of outcome

While our documents are based on the Highways Act 1980 and relevant case law, we cannot guarantee the outcome of any claim. The success of your claim depends on many factors including the strength of your evidence, the authority's maintenance records, and the specific circumstances of your case.

4. Plans and access

  • Claim Pack (£19.99): one-time purchase. Download your claim pack PDF immediately. No ongoing access.
  • Claim Assist (£29.99): one-time purchase. Includes 12 months of dashboard access, AI assistant (150 messages per month), and follow-up templates.
  • Claim Pro (£49.99): one-time purchase. Includes 12 months of dashboard access, unlimited AI assistant, rejection analysis, LBA, final demand, and precedent library.

Dashboard access for Claim Assist and Claim Pro expires 12 months from the date of purchase. After expiry, you retain any PDFs you have already downloaded.

5. Your responsibilities

You agree to:

  • Provide accurate and truthful information about your incident and damage
  • Not submit fraudulent or misleading claims using our documents
  • Keep your account credentials secure
  • Not share your account or generated documents for commercial purposes
  • Review all generated documents before submitting them to ensure accuracy

6. Payment

All payments are processed securely by Stripe. Prices are in GBP and inclusive of VAT where applicable. Payment is required before document generation.

7. Refunds

Refunds are available within 14 days of purchase, provided no documents have been generated. Once your claim pack PDF has been created, the service has been delivered and no refund is available. See our refund policy for full details.

8. Intellectual property

The claim pack documents generated for you are for your personal use in submitting your claim. The underlying templates, designs, and software remain the property of PotholeClaims.co.uk.

9. AI assistant

The AI claim assistant (available on Claim Assist and Claim Pro plans) provides general guidance based on the information you share. AI responses are not legal advice. Message limits apply per plan.

The AI assistant references UK highway law and established case precedents to provide general guidance. Case law references are sourced from our verified database. However, AI responses may contain errors and should not be relied upon as legal advice. Always verify case citations with a qualified legal professional.

10. Limitation of liability

To the fullest extent permitted by law, PotholeClaims.co.uk shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid for the Service.

11. Data protection

We handle your data in accordance with our Privacy Policy and the UK Data Protection Act 2018. Your data is stored in EU data centres and deleted when you close your case.

12. Termination

You may close your account at any time from your dashboard. We reserve the right to suspend or terminate accounts that violate these Terms.

12a. Account deletion and data removal

You may delete your account at any time from your dashboard settings. Upon deletion, all claim data, evidence files, uploaded documents, and AI conversation history are permanently removed. Payment records are retained in anonymised form for 7 years as required by UK tax law. This action is irreversible. Accounts with no activity for 15 months are automatically deleted.

13. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or notice on the website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

This document is for informational purposes only. It does not constitute legal advice. PotholeClaims.co.uk does not guarantee the success of any claim.

All documents generated by PotholeClaims are template letters designed to help you pursue a pothole damage compensation claim. They should not be treated as a substitute for professional legal advice. The outcome of any claim depends on factors including the strength of your evidence, the authority's maintenance records, and the specific circumstances of your case.

By using the Service, you acknowledge that PotholeClaims.co.uk is a document preparation service and not a law firm. No solicitor-client relationship is created by your use of this Service.
